The Nagpur bench of the Bombay High Court has refused to give immediate relief to a law student suspended until the investigation was pending by the college for posting on social media against ‘Operation Sindoor’. Justice Rohit Joshi said in his order of May 14 that at first glance the action taken by ‘Symbiosis Law School’ does not seem punitive, but it was administrative action. The final year student was questioned by the police after being found with independent journalist and Democratic Students Association of Kerala with Rajas Madepddie alias Siddiq, although he was not arrested. Siddiq was arrested for writing a critical post about the action taken by the Indian Armed Forces on terrorist bases in Pakistan after the terrorist attack in Pahalgam on May 7. The woman had filed a petition in the court last week requesting her suspension and the cancellation of the investigation launched by the college against her. Refusing to give him immediate relief, the High Court noticed the assurance of the institute that if he was freed in the investigation, then a special examination will be conducted for him later. According to the petitioner, his examination was to start from May 15. The High Court directed the institute to complete the investigation by 25 May and make the petitioner aware of the decision on the same day. The High Court said that the petitioner should also cooperate in the investigation and set the next hearing of the case on 27 May. The High Court said that the petitioner has uploaded a post contrary to the official stance of the Government of India regarding ‘Operation Sindoor’. The High Court said, “It is well known that the suspension order can be passed until the investigation is pending and the power to issue such an administrative order for suspension is with the disciplinary authority.” The judge said, “The matter is still in a very initial stage. All facts are yet to come to record. The institution has decided to suspend the petitioner and stop him from appearing in the examinations during the suspension period.” Justice Joshi said that the suspension disciplinary investigation will continue till the completion of.
