Supreme Court Hearing on Waqf Ends: The Supreme Court was completed on Thursday (April 22, 2025) on petitions challenging the validity of Waqf (Amendment) Act 2025. The court has reserved the verdict. In a three -day debate, the petitioners demanded an interim restriction against the rights of Muslims, while the Central Government strongly opposed it and stated the law to be correct. On Wednesday (May 21, 2025) on the previous day, the government argued that Waqf is an Islamic concept, but it is not an essential part of religion and hence is not a fundamental right. On this, Kapil Sibal said that Waqf is a dedication to Allah… for the hereafter. Unlike other religions, Waqf is a donation to God. Know what the Supreme Court said? However, the court said that religious donation is not limited to Islam only. Chief Justice BR Gawai said that there is salvation in Hinduism too. Donation is also a fundamental concept of other religions. Similarly, the second judge of the bench, Justice Augustine George Christ, mentioned a similar provision in Christianity and said, “We are all trying to go to heaven.” Chief Justice BR on the third day of hearing on the pleas of the petitioners. A bench headed by Gawai reserved its order on a petition to interim prohibit this law. What did the government say? Solicitor General Tushar Mehta opposed any interim order and argued that if the court feels that the law is unconstitutional after the final hearing, the court can cancel it but, if the court stops the law by interim order and during this time a property goes away, it will be difficult to get back, because it will not be easy to get it. Solicitor General Mehta said, both of them are different and donating to Waqf are different. This is the reason that 5 years of practice has been needed for Muslims, so that Waqf is not used to cheat anyone.
