There was a demand for appropriate guidelines in this case. Hearing the petition, a bench of Chief Justice Justice DK Upadhyay and Justice Tushar Rao Gedela has made important comments. A concrete argument was presented by Additional Solicitor General (ASG) Chetan Sharma. After this, the petitioner withdrew his petition. The Delhi High Court refused to consider a PIL (PIL) related to the vacancies of judges, saying that the process of appointment of judges is not like normal recruitment in public service. The case of vacancies and appointments of judges is constitutional. The bench of Chief Justice Justice DK Upadhyay was considering the PIL filed by senior advocate Amit Sahni. Amit Sahni was demanding a directive from the court on the issue of lack of judges in the Delhi High Court. He told in his petition that currently the High Court is working with the number of 36 judges against the 60 sanctioned posts. Delhi High Court Amit Sahni, who is working with 60 percent of the judges, also said that a judge of Delhi High Court had recently highlighted the shortage of judges in an order. The Delhi High Court is working on 60% of its sanctioned capacity. He further told the court that on 25 April, in an order, the High Court had accepted the matter of lack of judges and said that the number of judges is less in view of the number of population and litigation. Because of this, there is a problem in settling the matter on time. During the hearing, Chief Justice Justice Upadhyay commented, ‘All the people associated with the Judicial System are aware of this situation (lack of judges). It is not that efforts are not being made in this direction. Participating in the argument debate of ASG, Additional Solicitor General General Chetan Sharma also told the bench that the Supreme Court is already considering the matter related to the appointment of judges. After this, Sahni withdrew the petition. The High Court also allowed him to join the Supreme Court’s respective case as a party. Along with this, the High Court settled the matter. According to the Indian Justice Report- 2025 by the Tata Trust, there are less than one judge in the High Court on a population of 10 lakhs in Delhi. According to the report, the situation in the lower court is still better. There are 36 judges in lower courts at a population of 10 lakhs.
